Aliansi Bara-baraya Bersatu Tuntut Hakim Berikan Putusan Adil untuk Warga

Makassar, Cakrawalaide.com – Aliansi Bara-baraya Bersatu menuntut hakim memberikan putusan yang adil bagi 38 KK warga Bara-baraya dalam sidang putusan nantinya, yakni 12 Maret 2020.
Perkara sengketa tanah dengan Nomor 239/Pdt.G/2019/PNMks, antara warga Bara-baraya melawan penggugat atas nama Nurdin Dg. Nombong, kini telah memasuki tahap sidang kesimpulan di Pengadilan Negeri (PN) Makassar, Jl. R.A Kartini, Selasa (25/2/2020).
Edy Kurniawan Wahid selaku kuasa hukum warga Bara-baraya, mengungkapkan telah mengajukan kesimpulan berdasarkan fakta-fakta yang terjadi selama proses persidangan.
“Fakta pertama bahwa tanah sengketa yang diklaim milik penggugat bukanlah milik asrama atau dikuasai oleh TNI karena selama warga tinggal di area tersebut, mereka tidak pernah mendapat teguran dari TNI. Kedua masyarakat tidak mungkin langsung menyerobot tanah TNI,” ungkap advokat publik dari LBH Makassar tersebut.
Lebih lanjut, menurut Edy, warga menempati tanah yang kini jadi objek sengketa adalah secara sah dan legal. Dibuktikan dengan adanya kepemilikan berupa surat-surat.
“Warga memperoleh tanah itu dari jual beli, ibah, ada rinci ada penguasaan fisik, dan ada dasar haknya,” tambahnya.
Setelah melakukan aksi di depan Kantor PN Makassar, aliansi bergerak menuju ke Fly Over Makassar dan kembali melakukan aksi kampanye terkait upaya praktik perampasan tanah yang kian masif terjadi dan bagaimana dampak yang dirasakan oleh warga.
Salah satu warga Bara-baraya mengeluhkan ancaman pengusuran yang sedang mengintai tempat tinggalnya, sejak Nurdin Dg. Nombong mengajukan gugatan terhadapnya dan warga terdampak lainnya.
“Kami warga Bara-baraya menolak penggusuran yang terjadi di Bara-baraya. Di mana kami telah tinggal selama berpuluh-puluh tahun. Namun ada mafia tanah yang ingin langsung mengambil tanah tempat tinggal (kami) warga di Bara-baraya,” keluhnya di bawah Fly Over Makassar.
Tak hanya warga, Kekei sebagai Jendlap aksi juga menyampaikan dalam orasinya terkait masifnya praktik perampasan ruang hidup di Kota Makassar.
“Sudah banyak upaya pengusuran yang terjadi di Makassar, seperti Bara-baraya, Aliamin, dan Kakatua yang menyebabkan banyaknya warga kini terancam kehilangan tempat tinggalnya,” pekik Kekei dalam orasinya.
